Terms of Use

1. Acceptance of Terms

By accessing or using the TM Auto website, mobile application, or rental services, you agree to be bound by these Terms of Use and all applicable laws. If you do not agree with any part of these terms, you may not use our services.

2. Eligibility

To rent a vehicle from TM Auto, you must: (a) be at least 21 years of age (25 for certain vehicle classes); (b) hold a valid driver's license for at least 1 year; (c) present a valid government-issued ID; and (d) provide a valid payment method.

3. Reservations and Payments

All reservations are subject to vehicle availability. A valid credit or debit card is required at the time of booking. A security deposit may be held at pickup and released upon vehicle return in satisfactory condition. Rates are subject to change until a reservation is confirmed.

4. Rental Agreement

A separate rental agreement will be executed at the time of vehicle pickup. The rental agreement governs specific terms including insurance coverage, mileage limits, fuel policy, and prohibited uses. In case of conflict, the rental agreement controls.

5. Vehicle Use

Rental vehicles may only be operated by authorized drivers listed on the rental agreement. You agree not to use the vehicle for: illegal activities, off-road driving (unless in an approved vehicle), commercial transportation of passengers for hire, racing or speed testing, or transport outside approved geographic boundaries.

6. Cancellation Policy

Cancellations made more than 24 hours before the scheduled pickup receive a full refund. Cancellations within 24 hours may be subject to a cancellation fee of up to one day's rental rate. No-shows will be charged the full first day's rate.

7. Insurance and Liability

Basic liability coverage is included in all rentals as required by law. Optional collision damage waiver (CDW) and supplemental liability insurance are available at additional cost. You are responsible for any damage to the vehicle not covered by the selected insurance plan.

8. Traffic Violations and Tolls

The renter is responsible for all traffic violations, parking fines, tolls, and related administrative fees incurred during the rental period. TM Auto reserves the right to charge your payment method for any such fines plus an administrative processing fee.

9. Limitation of Liability

TM Auto's total liability for any claim arising from rental services shall not exceed the total fees paid for the specific rental transaction giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

10. Modifications to Terms

TM Auto reserves the right to modify these Terms of Use at any time. Continued use of our services following notice of changes constitutes acceptance of the revised terms. We recommend reviewing this page periodically.

11. Governing Law

These Terms are governed by the laws of the State of New York, USA. Any disputes shall be resolved through binding arbitration in New York County, except where prohibited by law.
